The owner and operator of this website and Webstore is Fiskars Finland Oy Ab, Keilaniementie 10, 02151 Espoo, Finland, registered under number 1903608-9. Fiskars Finland Oy Ab is the seller (later “Seller”, “Sponsor” or “we”) of the products offered at Moomin Arabia Webstore. Moomin Arabia Webstore is located in the address www.moominarabia.com, referred into as “Webstore”.

1.    General

These Sales Terms together with our Privacy Policy, our Cookie policy , Site Terms, specific instructions on Raffle Rules, Shipping & Deliveries, Payment, Returns & Refunds pages , as well as any additional terms (including but not limited to campaigns or promotions and specific product restrictions) and information that may be provided to you  (collectively “Terms”) are applicable to all entries and purchases made on our Webstore.

BY ENTERING THE RAFFLE IN THE WEBSTORE AND CHECKING THE TERMS ACCEPTANCE TICK BOX AT THE CHECKOUT PHASE YOU AGREE TO THESE TERMS. If you refuse to accept them, you will not be able to enter the Raffle.

We reserve the right to make changes to these terms and conditions at any time. The terms and conditions in force at the time of your entry will apply to you.

Any notices, disclosures, agreements and other communications relating to your use of the Webstore will be provided to you electronically.

We shall also have the right, without notice and without liability for compensation, to restrict or withdraw access to the Webstore, remove elements from the Webstore from use or restrict the use of certain functions and services of the Webstore, in whole or in part.

Except where prohibited and without limitation to any statutory rights for consumers, the entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Raffle or any awarded eligibility to purchase the Product shall be resolved individually, without resort to any form of class action, in the competent courts of the entrant's country of residence. All issues and questions concerning the construction, validity, interpretation and enforceability of the Terms, the entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Raffle, shall be governed by, and construed in accordance with, the laws of Finland without regard to choice of law provisions. The courts of the city where the Seller is established will have non-exclusive jurisdiction in relation to the Terms. For the avoidance of doubt, the choice of law set forth in this article shall not set aside any statutory rights of the entrant and do not affect your legal rights which cannot be waived or limited by contract. 

We will try to resolve any disputes with you directly. If you and we cannot resolve a dispute using our internal complaint handling procedure, you may also use the online dispute resolution (ODR) platform to resolve the dispute with us. 2.    The Moomin Sea Breeze Platinum Raffle

2.1  Who is sponsoring the Raffle?

The Raffle is sponsored by the Seller. The Seller reserves the right to terminate the Raffle after it has already started if it cannot be operated, conducted or completed as planned.

2.2 Who is eligible?

The Raffle was created to ensure a level playing field for all users. The Raffle makes it possible to purchase the Moomin Arabia Sea Breeze Platinum mug (the “Product”), but does not create a contract of sale. Any purchases are governed by a separate agreement, subject to the Terms.

This Raffle is open only to legal permanent residents of Finland (excluding Åland), Sweden, Norway, Denmark, Lithuania, Latvia, Estonia, Poland, Germany, Ireland, The Netherlands, Luxembourg and Belgium, who are 18 or older at the time of entry. Employees of the Sponsor and anyone else professionally involved with the Raffle are excluded from entering. The Raffle is for individual consumers, not businesses.

Participation constitutes the entrant's full and unconditional agreement to the Terms and Our decisions, which are final and binding in all matters related to the Raffle. Eligibility is contingent upon fulfilling all requirements set forth herein.

2.3 How do I participate?

Navigate to www.moominarabia.com and complete registration. There is a limit of one (1) registration per person, and one (1) Product per entry. Subsequent registrations will be void. You will need to provide contact information, delivery address and valid credit card details, which will be used by the Sponsor to make a reservation for the amount of EUR 99,90. Your credit card will not be charged the full cost of the Product unless you win. See below for further information. In case you do not win in the Raffle, you will be informed by email and your credit card reservation will be released in accordance with your bank’s procedures, which may take several working days. 

2.4 How will the eligibility to purchase the Product be provided?

The Sponsor will select the entrants in a random drawing of all entries received. The odds of receiving eligibility to purchase depends on the number of eligible entries received and availability of the Product. Both winning and non-winning entrants will be notified by email within approximately twenty-four (24) hours of the Raffle closing. If an entrant has violated any of the Terms, then an alternative entrant may be selected, at the Sponsor's discretion.

2.5 What can I receive?

Winning entrants will be able to buy the Product. If you are selected, your credit card reservation will be charged on 13th June, when the Raffle will conclude and winners selected in a random draw.  The sale will be made final upon selection. Products will be delivered after the Raffle concludes. The purchase of the Product is governed by the Terms.

2.6 How is my personal information used?

Information collected from entrants is handled in accordance with the Fiskars Group Consumer Privacy Policy.

2.7 What other terms should I be aware of?

The Raffle is void where prohibited by applicable law. In the event that the operation, security or administration of the Raffle is impaired in any way for any reason, including, but not limited to, fraud, virus or other technical problem, the Sponsor may, at its sole discretion, either: (a) cancel or terminate the Raffle; (b) suspend the Raffle to address the impairment and then resume the Raffle in a manner that best conforms to the spirit of the Terms; or (c) award the eligibility to purchase the Product at random from among the eligible entries received up to the time of the impairment. 

The Sponsor reserves the right, at its sole discretion, to disqualify any individual it deems to be tampering with the entry process or the operation of the Raffle, has attempted to cheat or abuse the process, including through use of programs or scripts that allow users to automate their entries, or to be acting in violation of the Terms or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Raffle may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any term of the Terms shall not constitute a waiver of that provision.

In the event that the Sponsor is prevented from continuing with the Raffle or the integrity and/or feasibility of the Raffle is severely undermined by any event beyond the control of the Sponsor, including but not limited to fire, flood, epidemic, earthquake, explosion, labour dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any government law, order or regulation, order of any court or jurisdiction, infection by computer virus, unauthorised intervention, technical failures or other cause not reasonably within the control of the Sponsor (each a "Force Majeure" event or occurrence), the Sponsor shall have the right, at its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Raffle without any further obligation.

By participating in the Raffle, entrants agree, to the maximum extent permitted by applicable law, that the Sponsor, its parent and related companies and their respective officers, directors, employees and agents (the "Released Parties") shall not be liable for any damages or costs arising out of participation in the Raffle or purchase of the Product, including, but not limited to: (a) unauthorised human intervention in the Raffle; (b) technical errors related to computers, servers, providers or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected or undeliverable mail; (e) errors in the administration of the Raffle or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from the entrant's participation in the Raffle or purchase of the Product. To the maximum extent permitted by applicable law, the entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages. The entrant agrees that the Released Parties have made no warranty, representation or guarantee, expressed or implied, in fact or in law, relating to any eligibility to purchase the Product.

3.   Raffle Entry & Selection Process 

1. How do I enter the Raffle?

The Moomin Arabia Sea Breeze Platinum Edition mug (Product) can only be obtained through a winning entry in the Raffle. To participate in the Raffle:

1.1.  visit moominarabia.com between 7th June 2023, 08:00EET and 13th June 2023, 08:00 EET

1.2.  sign up for the Raffle. You will be asked to provide your contact information, shipping address and a valid credit card number. We will reserve 99,90€ on your credit card. 

1.3.  the Raffle winners selection will be held on 13th June. For winning entries the credit card will be charged. For non-winning entries, the credit card reservation will be released.

1.4.  you may only participate once, and enter for the Raffle for one (1) Product.

1.5.  you can participate in the Raffle for the Product at the Webstore if you satisfy the conditions below:

    • you are at least 18 years of age;
    • you are the owner or authorized holder of a valid credit card to pay for your purchase; 
    • your credit card has sufficient credit to make the credit reservation;
    • you agree to provide your real name and correct and complete address, phone number, email address, payment details and other required information; and
    • you are a legal resident of Finland (excluding Åland), Sweden, Norway, Denmark, Lithuania, Latvia, Estonia, Poland, Germany, Ireland, The Netherlands, Luxembourg or Belgium.
1.6.  Winning entries will be contacted by email. Please make sure to provide a valid email address.
2.  Can I enter by phone?

The Moomin Sea Breeze Platinum mug is only obtainable through the Raffle. We’re unable to accept phone entries but we’re happy to assist you in guiding you through the sign up process for the Raffle. Kindly contact our Customer Service.

3. Can I amend my entry once I have submitted it?

Our Raffle entry process allows you to check and amend any errors before submitting your entry. Please take the time to read and check your entry at each stage of the process.

4. How is my entry confirmed?

The confirmation stage of the entry process sets out the final details of your entry. Following your submission, we will send to you an email, acknowledging receipt of your entry (“Entry Confirmation”). However, please note that this does not mean that you have been chosen as a winner. 

5. Can I cancel my entry?

Once submitted and accepted, entries cannot be cancelled, but please note that if you are selected, there’s a 14 day return period. For more information about returns, please go to Returns & Refunds.

6. Can I change the shipping address after signing up for the Raffle?

We are not able to change the shipping address once you have submitted your entry. Please make sure to fill in the correct shipping address at the time of signing up for the Raffle.

7.  Can I change the number of products after signing up for a Raffle?

Only one (1) product per entrant. You may not change the number of Products after signing up for the Raffle. 

8. If I am selected as a winner, when is the sale completed?

Completion of the contract of sale between you and us will take place on dispatch to you of the Product, at which time we will send to you a shipment confirmation email.
